As an unlicensed wholesaler, you can only market your rights and obligations under the purchase contract — not the property listing itself. Minnesota also treats anyone acting as principal in 5 or more transactions in a 12-month period as “in the business of selling real estate,” which requires a broker’s license.
  • Iowa: wholesalers can assign their equitable interest in a contract, but marketing has to stay focused on that contract interest — not the property itself — and disclosure of your role and intent to assign is required. Iowa wholesaling rules have been under legislative review, so the specifics are worth confirming with an attorney before every deal.

This is exactly where most wholesalers hit a wall: real buyer volume lives on the MLS, but the MLS is only accessible through a licensed broker.
